never intended any harm to recipients of the letters.
LIVEZLY sent the letters as he became aggravated at kidding
he received from RCA employees whose names he used as
the senders; the Vi-.¥i¢1~1__§___lé;&#39;§il_ers_,., R945 Plant Physician,
who has been treating LIVEZLY as

advised his file contains no listing of mental disease
or treatment for LIVEZLY. RCA physician considers LIVEZLY
as eccentric but one who knows what he is doing and who
is absolutely responsible for his actions. AUSA HOROWITZ,
Newark, N. J., declined prosecution as facts do not 
indicate subject is dangerous or any real threat to persons
receiving the letters and there was no need to invoke
criminal process. AUSA feels there is need to have subject
receive phychiatric study but that is more properly
responsibility of local authorities. Camden County
Prosecutor&#39;s Office and Gloucester County Prosecutor&#39;s
Office advise that they are unable to have subject
committed for phychiatric study or treatment. FBI
Laboratory advised letters sent in this matter examined
in Laboratory conform to Laboratory standards for a Royal
Pica style of type spaced ten letters to an inch,

Investigation in this case is predicated upon
receipt or a telephone call from the Federal Bureau of
Investigation, Washington, D. C., to the Newark Office
of the FBI on September 13, 1967, that two letters had
been received, both postmarked September 12, 1967,
One of the letters was addressed to Mr. J. EDGAR HOOVER, &
FBI Headquarters, Washington, D. C., and contained obscene
language. The letter dated August 12, 1967, demanded
the payment]$1,000,000,000.00 and stated that if the
money is not paid by next Sunday the letter writer, Ibthreatened to kill the recipient of the letter, This b$cletter was typewritten and was irgml |

e his supervises the work of LEVEZEY for twenty
years and he has always felt sorry for LIVEZLY and has
considered him to be a pathetic individual.
[:::::]advised that LIVEZLY only has one eye
and when he was a youngster, LIVEZLY was playing with
dynamite caps on the railroad when one of the caps
exploded and LIVEZLY lost an eye.
E::::::::]advised that he feels that possibly
this explosion may be the cause oi LIVEZLY being aneccentric and a real odd ball". E::::::]adViSed LIVEZUY 
*always&#39;earries a suitcase with a change of clothing and
. LIVEZLY does get upset about the men in the Woodworking b6Shop making fun oi him. b7@
|:|advised that LIVEZLY used to utilize
the shower room at the plant for his baths but it was
discovered during the basketball season that when the RCA
ball players would come to the shower room to get
cleaned up following a ball game there would not be any
hot water. It was discovered that LEVEZLY was using the
shower room for his baths and LIVEZLY was using as much as
80 gallons of water to bathe. As a result, there was no
hot water for the basketball team. LIVEZLY was prohibited
from taking his showers on RCA groperty.

facilities at his home in Woodbury, N. J., and goes to
30th Street station of the Pennsylvania Railroad&#39;where»
he uses public bath facilities to bathe.

over the world to various prominent people, including
royalty, and also to prominent people in the United
States. All of the letters are typed and are of a
congratulatory or sympathy nature.
, LIVEZLY always receives replies to his letters
which he shows to everyone he meets at RCA, Camden, N. J.
Plant. [:::::]advised that he recalls seeing one answer
LIVEZLY received to a letter which had been sent to
Mrs. MAMIE EISENHOWER. He believes that it was sent when
_former President EISENHOWER had been ill.

Building 11-1 which is located near the woodworking
section, E went into the room around 2:45 P.M. and

On September 14, 1967, the facts of this case were "
presented to Assistant United States Attorney DONALD HOROWITZ,
First Assistant to the United States Attorney, by Assistant &#39;
Special Agent in Charge KARL IQBROUSE at Newark, New Jersey.
HOROWITZ advised that in his opinion, in view of
subject&#39;s background, invoking criminal process is not thesolution in this case at this time and he would not authorize
prosecution of subject,
Mr, HOROWITZ stated the facts do not indicate
subject is dangerous or any real threat to the persons-who
received the letters and there was no need to invoke
criminal process; He feels, however, there is need to have

this is more properly the responsibility of the local
authorities;

he explained that under Federal Criminal Procedure
a subject cannot be afforded psychiatric treatment until he
is convicted which could take some time and he
felt local authorities would be able to take more direct I
action;
" On September 14, 1967, it was brought to the attention
of Mr. PJROWITZ that the subject had also sent two letters,
one to President JQHNSON and one to Mrs. JOHNSON, at the
White House, Washington, D,¬, This information was not
available at the time the matter was originally presented
to Mr. HOROWITZ, Mr; HOROWITZ advised that this additional
information does not change his original opinion to decline
prosecution in this matter,
_ On September 15, 1967, the contents of the letters
sent by LIVEZLY were brought to the attention of Assistant
Prosecutor ALBERT SCARDUZIO, Camden County Prosecutor&#39;s
Office, Camden, New Jersey, 
¢ Mr. SCARDUZIO advised that he does not see any way
subject can be committed to mental institution for psychiatric
evaluation unless he voluntarily signs-own commitment papers.
SCARDUZIO stated that the normal procedure for having someone
committed in New Jersey is for a close relative, residing
with him, to have subject examined by one or more physicians
who would recomend committal based on examination,
The commitment would be for a temporary ten day period
following, which the individual could be committed
permanently upon the recommendation of the institution and
proper papers signed by a county judge, SCARDUZIO advised .. &#39;
that as LIVEZLY lives alone, has no close associates or relatives,
he does not feel this could be accomplished;
SCARDUZIO pointed out another way oi committing
subject would be if he were arrested on local charges and
the arresting agency, at its discretion, could immediately
commit the individual for a ten day temporary period. This
could be made permanent upon the recommendation of the
institution, SCARDUZIO pointed out that on the basis of

information that subject has engaged i
&#39;lewd*acts within,
the confines of RCA, Camden, New Jersey, a local complaint
could be signed by RCA officials which could be used to
commit subject. He pointed oat that this would not be done
by RCA as it might place the company in a delicate position
with the company union. He advised the mailing of the
extortion letters in Camden, does not violate any local
law as the letters are being sent to points outside the state
SCARDUZIO advised any effort to have subject
committed would have to be arranged.through the Gloucester
County, New Jersey Prosecutor&#39;s Office, which office covers
subject; residence in Woodbury, New Jersey.
On September 15, 1967, DOMINICK TATTUSO, Assistant
Prosecutor, Gloucester County, Woodbury, New Jersey, advised
subject is known to him very casually as an eccentric who -
resides in that community; TATTUSO stated subject has never
been arrested in Gloucester County and has not violated any
local law, and therefore, no steps can be taken on that
basis to commit him for_menta1 treatment or examination,
TATTUSO advised that the mailing of extortion letters, which
is a Federal violation, with their destination outside of
the State of New Jersey, would not have violated any local
law in Gloucester County, even if mailed within the county.
It is his opinion that as the subject has no close relatives,
the only way he could be committed would be if he voluntarily
signed himself into an institution, If this were done he
could sign himself out of the institution at any time.

Mr. SATZ advised that his office will not be able _
to take any affirmative action toward having LIVEZLY committed
for psychiatric evaluation. Mr. SATZ advised that he
discussed this matter with Assistant United States Attorney
ROBERT W. PAGE at Camden, New Jersey, and he is satisfied
that under existing New Jersey Statutes no legal remedy is
available under which LIVEZLY can be committed,
_ Mr. SATZ expressed the opinion that he does not
believe that LIVEZLY is a dangerous type individual and
he does not believe that recipients of the letters in questionl
were actually placed in fear of personal harm.

Police Department records disclose that on September 14, 1967,
CHARLES LIVEZLY, 12 East Barber Avenue, Woodbury, New Jersey,
employed at RCA, Camden, New Jersey, filed a larceny complaint
with the police department,
LIVEZLY reported that at&#39;11:45 P,M, on September 18,
1964, one white, male, approximately 19 years of age, who V
is supposed to work in Polsky&#39;s Department Store came to visit
LIVEZLY. This boy would not sit down until he took his
pants ofi to keep them from getting wrinkled, so he claims,
"During the visit the boy returned LIVEZLYs wallet
which he lost the other day. LIVEZLY had a $50,00 bill on
the bed. He put the $50.00 bill in his wallet, and the
wallet into his pants pocket. LIVEZELY then removed his pants
hung them on the sofa, and went into the bathroom to get
ready for bed. When LIVEZLY returned from the bathroom
~the boy put on his pants and left, This was at approximately
12:45 A.M. on Saturday, September 19, 1964. When 
LIVEZLY checked his wallet the $50.00 was gone, The money
was where the boy could see it before LIVEZLY put it into
his pocket. The only thing that LIVEZLY knows about the boy
is that he is tall and slim and is supposed to work for
JOE POLSKY&#39;s Department Store,"

has knowledge of his perversions, upon inter -
view admitted writing these letters and
threatening letters to Cardinal Krol and
President Johnson. Subject signed names of

Charles Augustus Livezly, 12 East Barber,
Woodbury, New Jersey, furnished a signed statement duringthe evening of September 14, 1967, &#39; 
John E. Otto, Philip §. Carroll and |
On September 12, 1967, Livezly composed and
mailed from Camden obscenely worded letters containing
ademands for money and threats against the lives of the
recipients who were the President of the United States,
Lyndon B. Johnson, Mrs. Lyndon B. Johnson, the President&#39;s
wife, J. Edgar Hoover, Director of the Federal Bureau of
Investigation, a Mrs. J. Edgar Hoover, intended for a wife
of Mr. Hoover, Cardinal John Krol, a Roman Catholic prelate
of Philadelphia, Pennsylvania,
Livezly could not recall the exact wording he used
in his letters to President and Mrs. Johnson, however, he
stated they did contain threats to kill each of them.
He stated, to the best of his memory, the envelope of the
letter to the President was addressed to President Johnson
while the envelope of the letter to the President&#39;s wife
was addressed to Mrs. L. B. Johnson in care of the White
House, Washington, D. C.
Livezly said he thought he signed the name of

plant in Camden to write the letters, The paper and
envelopes he used he purchased himself. He furnished
sheets of paper of the same type he said he write the
letters on. It is 10%" by 6" and hears the watermark
of "Guild Caxton Bond". He also furnished envelopes in
which he stated he mailed the letters. The envelopes are3%" by 6%" and were contained in a box marked "Rexall
Economy ?ach, 100 Envelopes, The Rexall Stores, StationeryDepartment, S-67, Rexall Drug Co., Los Angeles, California"The price for the box oi envelopes was indicated as ",39¢".blank
| _ I RCA, Camden,New Jersey, said Livezly has been caught on several
occasions commiting masturbation in the men&#39;s bathrooms
at the Camden RCA Plant. In addition, Livezly, accordingto[:::::::] has often walked up behind other employees
at RCA and grabbed their buttocks without forewarning.Livezly, when he has been ignored while trying to getsomeones attention, has licked the bash of that person&#39;s
neck with his tongue.
Livezly admitted to interviewing Special Agents
without further explanation.0 t two months ago, at a time when he was angry wi&#39;
he mailed a photograph of a nude woman to
RCA,Camden, advised about one month ago Liveziy, forlnoapparent reason, used profane and abusive language against
him in one of the plants restrooms for men.

_ RCA Company Doctor, _ J said hehas seen Livezly continuously as a patient at the plant since
1962. stated Livezly has no history of mental 
disease nor as e been treated for mental illness, to the
best of his l:nowledge. conSiders Livezly to be
eccentric but one who knows what he is doing. He feels
Livezly is absolutely responsible for his actions.
Livezly said he does not possess a firearms or
any type of dangerous weapon.
On September 14, 1967, the facts of this case were
presented to the Offices of the United States Attorney, Newark
New Jersey, to Assistant United States Attorney Donald
Horowitz, who advised that from the background of Charles
Augustus Livezly, they feel that the invoking of criminal
process is not the solution to this case. Mr, Horowitz
advised that in his opinion, Livezly is not dangerous and
is no real threat to the recipients of the letters.
Mr. Horowitz advised that he feels that a medical
evaluation of Livezly is the responsibility of local 
authorities and that a full disclosure of the facts of this
matter and the nature of the letters should be brought to
the attention of local authorities.
Mr. Horowitz advised that under the rules of Federal
Criminal Procedure no medical evaluation of Livezly could
be effected by the Federal Government until Livezly is
either convicted or has entered a plea of guilty to the
charge against him, ,
Mr. Horowitz advised that he will not authorize
issuance of a warrant, and he declined prosecution in this
matter. -
Mr. Elbert Scarduzio, Assistant Camden County
Prosecutor, was advised oi the above facts on September 15,
Dominick Tattuso, Assistant Prosecutor, Gloucester
County, was also advised on September 15, 1967, as Livezly
resides in Gloucester County.

£},j.é2ai&#39;lier today I spoke with E. L ar Sledge in the DeprtmentI and reviewed with him the facts of this matter. I told Sledge thé in view
of the subject&#39;s extensive letterwriting activities, the obscenities used,
and the obvious sexual unbalance of the subject, the Bureau felt strongly
that Livezly should be picked up and taken out of circulation. Sledge said
that after looking over the letters subject Wrote he agreed and that he would
contact AUSA Horowitz in Newark and attempt to convince him that process
should be filed.
A1: 5:50 p. m. , tonight, Sledge called back and stated that he had
just been  touchlwith AUSA Horowitz and that Horowitz and the U. S.
Attorney affé both in agreement that subject should not be arrested. They
feel that a,.c"=riminal arrest is not the answer. Sledge said that Horowitz
was still reviewing the matter and wanted to explore other avenues to have
the subject committed. He said that he would be able to furnish an answer
by next Tuesday morning.
I told Sledge that Livezlys background is such that he would be a
K prime suspect in any sexual crime committed such as child molesting, etc. ,gg and that the Government would be derelict in not taking all action to remove

President L. B. Johnson and Mrs. L. B. Johnson, bearing postmark
9/12/67, Camden, New Jersey. Xerox copies of these letters were
received through FBI liaison with Secret Service.
Immediately make available copies of the letters and
