Court documents allege Juan Ramon Hernandez, 22, shot at and missed a group of rival gang members June 30 in the 1400 block of Dakota Avenue. A Medford police affidavit identified Hernandez, 25-year-old Luis Ortega-Arechiga and Jose Guadalupe Hernandez, 21, as members of a local Sureños gang subset and said they had been driving around west Medford looking for members of a rival gang when they found them in front of the Dakota Avenue house. According to the affidavit, Jose Hernandez told police the group had planned to physically assault their targets and that he was surprised when Juan Hernandez pulled out a handgun and fired at the rival gang members before the group drove off. The affidavit said the bullet missed all of the intended victims and lodged in the side of a nearby house.  Police arrested Jose Hernandez July 15 and Juan Hernandez Aug. 7. Jose Hernandez was booked in the Jackson County Jail and released on his own recognizance following his initial arraignment, while jail records show Juan Hernandez is being held in lieu of $215,000 bail.  Juan Hernandez now faces charges of attempted first-degree assault and unlawful use of a weapon under an indictment filed July 23, both of which would carry mandatory five-year sentences under Oregon law because of the alleged use of a firearm in the commission of a crime. Hernandez, Ortega-Arechiga and Jose Hernandez are all also charged with conspiracy to commit third-degree assault under the indictment filed July 23.  Ortega-Arechiga has yet to be arrested. Court documents show Juan Hernandez currently has another open felony case on a meth-possession charge and is on probation for a previous fourth-degree assault conviction.
