Medford man found not guilty of rape charges Chad Barriga is exonerated on Measure 11 counts, found guilty of fourth-degree assault A Jackson County jury on Wednesday found a Medford man not guilty of Measure 11 charges related to a 2011 rape case. Instead, Chad Dean Barriga, 33, was found guilty of fourth-degree assault after a two-day trial in Judge Lorenzo Mejia's courtroom. Instead, Chad Dean Barriga, 33, was found guilty of fourth-degree assault after a two-day trial in Judge Lorenzo Mejia's courtroom. Barriga had been charged with two counts of first-degree rape, two counts of second-degree sex abuse, one count each of first and second-degree kidnapping, three counts of strangulation and two counts of fourth-degree assault in connection with a rape that allegedly happened June 13, 2011. Barriga has been held in jail on $1 million bail since his arrest. He was given a one-year sentence and given credit for time served. He was released later that day, said prosecutor David Hoppe, who expressed disappointment in the verdicts. Barriga has numerous previous arrests for domestic violence, sexual assault and stalking. He is a registered sex offender with a first-degree sexual abuse conviction in 1998 on his record, Hoppe said. The jury was told about Barriga's prior history because he took the stand during his trial — against the advice of his court-appointed attorney, Christine Herbert. The victim was receiving treatment at a local hospital when she saw a Medford officer there on an unrelated matter. She approached the officer, saying that she had been physically and sexually assaulted by Barriga, Medford police said. A sexual abuse victims' advocate from Community Works was dispatched to provide help for the victim, Chief Tim George said at the time of Barriga's arrest. After the arrest, Barriga alledgedly phoned the victim three times and sent her a card from jail. Medford police in 2011 added a charge of stalking against Barriga, who was accused of raping a former girlfriend. The stalking charge was dropped before the trial, said Hoppe. At a motion hearing Monday before Judge Tim Gerking, Herbert asked to be released from serving as Barriga's attorney. Gerking denied Herbert's request Barriga previously refused the counsel of another court-appointed attorney, Gerking noted. Barriga said he wanted Herbert to remain as his attorney, and said he wanted to be able to ask questions of witnesses directly. Mejia allowed Barriga to ask direct questions of a Medford police detective during the trial. First-degree rape carries a mandatory minimum prison sentence of eight years, four months upon conviction. The kidnapping charges carry mandatory sentences of seven years, five months and five years, eight months, respectively. Second-degree sex abuse, strangulation and forth-degree assault are all misdemeanors. Jurors were instructed they needed at least 10 members to agree on each charge to render their verdicts of guilty or not guilty.
