If someone is murdered in a home that is up for sale, does the real estate company have to disclose this fact to the prospective buyer up front, or can they say nothing unless they are asked? — JoeAnn J., Medford Mark Moseley, manager of the regulation division at the Oregon Real Estate Agency in Salem, notes that under Oregon Revised Statute 93.275 it is not a material fact in a real estate transaction that certain events have occurred. Among them are the fact or suspicion that the property was the scene of a death by violent crime or that the property was the site of a crime that does not adversely affect the physical condition of or title to real property.
