The Jackson County District Attorney’s Office announced Tuesday that the murder charge alleges that Atwood intentionally caused Lemich's Aug. 5 death and the first-degree manslaughter charge theorizes that Atwood recklessly caused Lemich's death under circumstances manifesting an extreme indifference to the value of human life. Police previously reported that officers went to check on a homeless man camping on the Bear Creek Greenway around 9 a.m. Aug. 5. When officers arrived on scene, they found Lemich's body amid suspicious circumstances and called in the Jackson County Major Assault and Death Investigation Unit to assist detectives. The grand jury heard from five witnesses, including Detective Mike Wojack and Officer Brian Munoz of the Central Point Police Department, Detective Tony Young of the Medford Police Department, Deputy Medical Examiner Randy Arnold and a civilian witness whose name wasn't released. The testimony took about 45 minutes, and the grand jury deliberated for approximately 10 minutes before announcing that an indictment had been issued, prosecutors reported in a news release. Atwood is being held without bail in the Jackson County Jail. The Jackson County Circuit Court will schedule a date for his arraignment on this indictment, officials said. The case is being prosecuted by Senior Deputy District Attorney Allan E. Smith with assistance from Deputy District Attorney Marco Boccato.
