The grand jury is scheduled to hear testimony from OSP trooper Nick Neville, who shot and killed 47-year-old Jeremiah Paul Scanlon on March 26. Scanlon shot Neville in the neck above his bullet proof vest. Released from the hospital on March 29, Neville still carries Scanlon’s .38-caliber bullet in his body. The grand jury will decide whether Neville acted lawfully, said Beth Heckert, chief deputy district attorney for Jackson County. In addition to Neville’s testimony, jurors will hear reports from other police officers, the state medical examiner and an expert in an unspecified field, Heckert said. Preliminary information indicated that Neville acted appropriately, authorities said. Neville encountered Scanlon at the boat ramp in Valley of the Rogue State Park near Interstate 5 on March 26. Scanlon’s pickup truck drove past his marked patrol car and tried to turn around on the boat ramp at 8:40 p.m. Both men got out of their vehicles, and Scanlon asked the trooper for directions, investigators said. When Neville requested the man’s identification, Scanlon pulled a snub-nosed .38-caliber revolver from his clothing, police detectives said. Advertisement Neville dropped onto one knee to avoid the shot from Scanlon’s weapon and pulled out his own gun, said OSP Capt. Eric Rodriguez. The trooper shot Scanlon once in the front, right side of his chest. Still clutching the revolver, Scanlon ran about 35 yards uphill from the boat ramp and collapsed spread-eagled on the ground, Rodriguez said. Officers found him there when Neville radioed for help. Scanlon was wanted on warrants issued by the FBI charging him with armed bank robberies in Las Vegas and Reno, Nev., on March 15 and 19. The gun he used had been reported stolen in Las Vegas, as well as the license plates on his vehicle. Scanlon had told friends that he wasn’t going back to prison, Rodriguez said. Scanlon’s bullet smashed through Neville’s collar-bone and lodged under his shoulder blade, according to reports from family members. Physicians decided to leave the bullet in place rather than perform an invasive surgery, Neville said. Neville has not yet returned to work, said OSP Lt. Kurt Barthel. Neville, a Rogue Valley native, has worked for OSP since 1999 and was stationed in the agency’s regional headquarters in Central Point in May last year.
