Jose Valencia-Cardenas, 51, of the 700 block of Talent Avenue, was indicted on charges of second-degree assault and fourth-degree assault for the alleged Feb. 20 whipping. A Jackson County Circuit Court hearing on his case is scheduled for Monday. According to an affidavit, Valencia-Cardenas got in an argument with his 17-year-old daughter. He allegedly removed his belt and beat her with it numerous times. The alleged victim "received abrasions and significant contusions, which impeded her ability to walk normally and without pain for more than one day. Bruising is apparent several days later," a Medford police officer wrote in the affidavit when he saw the girl six days after the alleged beating. Valencia-Cardenas admitted to hitting the teen with the belt, the affidavit said. Upon conviction, second-degree assault carries a minimum sentence of five years and 10 months in prison under Measure 11 sentencing laws in Oregon. The fourth-degree assault charge Valencia-Cardenas is also facing is a misdemeanor, according to court records. A check of court records statewide showed no other charges against him going back at least five years.
