Oregon Road Conditions & Cams Email Story to a Friend February 10, 2006 City Council decides Dyal did no wrong By MEG LANDERS Mail Tribune City Manager Mike Dyal will face no disciplinary action for his decision to discontinue offering health insurance for retired employees, the City Council decided Thursday. After holding its fifth closed session on the issue, the council voted 6 to 1 in a public meeting to back Dyal’s decision, which took effect in 2002. "Allegations were made by past employees as to certain charges of misconduct on the part of the city manager," Councilman Jason Anderson said in a statement. "The City Council hired outside legal counsel to investigate and analyze these charges. ... Based on advice of legal counsel, we cannot discuss in public any of the evidence presented at these executive sessions due to potential liability. "Based on these executive sessions I move that a finding be made on the record that there was no misconduct on the part of the city manager." Advertisement Councilman John Statler cast the lone vote against the finding. "The citizens certainly deserve an explanation of my ‘no’ vote," he said Thursday afternoon. "I can’t give one because of pending and potential litigation." Anderson, Claudette Moore, Bob Strosser, Jim Key, James Kuntz and Skip Knight voted for the motion. Councilman Greg Jones, who retired as director of the city parks department in 2002, recused himself from the discussions. In September, retired city attorney Ron Doyle filed a notice to sue, accusing the city of breaking state law by denying continued insurance to some retirees. Eight other retirees from the city of Medford filed similar claims. In November, Doyle told the City Council it should fire Dyal or request his resignation. The city’s liability insurance company hired Robert E. Franz Jr., a Springfield attorney, last month to "evaluate, investigate and defend if necessary" possible lawsuits against the city over lack of continued health insurance for retirees. Doyle declined comment Thursday. Franz did not return a phone call by press time, but he has said previously he will not speak to the press.
