Brian J. Costa, 52, of southwest Portland, and John A. Dougal, 42, of north Portland, were arrested by U.S. Marshals Monday afternoon, and booked and released from Multnomah County Jail on charges including possession of child pornography and producing child pornography. The men were arraigned Tuesday in U.S. District Court in Medford shortly before an affidavit in support of a criminal complaint was released to the public detailing the findings of the federal investigation. According to the criminal complaint, Costa allegedly met the 15-year-old boy in March through the online dating site silverdaddies.com. The website's front-page welcome banner says "This site is a meeting place for mature men and other men (both daddies and younger), who are interested in keeping their daddy happy and/or sexually satisfied." The affidavit said that throughout their relationship, Costa would refer to the 15-year-old as "my boy," and the boy would refer to Costa as "my daddy," in conversations. Initially, the 15-year-old's profile on the website said that he was 18, but he told investigators that soon after his relationship began with Costa he revealed to him that he was only 15 and Costa said he was "okay" with that. Costa, marketing director for Tuality Healthcare hospital in Hillsboro, was charged with transferring obscene material to a minor, enticing a minor to engage in unlawful sexual activity, using a minor to produce visual depiction of sexually explicit conduct, mailing child pornography and possession of child pornography. Tuality Healthcare released a statement on the matter Tuesday, announcing that Costa had been suspended without pay and distancing themselves from the incident. "None of the allegations in the criminal complaint are related to Mr. Costa's work or responsibilities at the hospital," the statement said. In March Costa initiated the idea of meeting while having a conversation with the teenager on Yahoo's instant messenger, a primary source of communication for the two during their relationship, the complaint said. On March, 20, in an alleged online conversation between the two, Costa said that he wanted drive from Portland to meet the boy in Medford over the weekend, and the boy agreed. Costa picked the boy up in Medford on the following Saturday, March 27, and they went to a motel in Central Point where Costa had reserved a room under his name, the complaint said. The complaint alleges that after reaching the motel room Costa and the boy allegedly engaged in sexual acts; which Costa videotaped and photographed. Before and after meeting on March, 27, Costa and the boy swapped sexually explicit photographs of each other over the Internet frequently, the complaint said. On May, 5, the two agreed to meet again in Medford, but Costa requested that he bring a friend, Dougal. The three of them allegedly met in Medford and drove to a motel in Medford. The affidavit said that in a room registered to Costa, the three of them engaged in sexual contact. The complaint said that both Costa and Dougal took photos and videotaped the sexual acts between the three. Shortly after their second meeting, the boy's mother found out about the alleged sexual encounters and contacted Medford police. Police were able to locate video surveillance footage from the Medford motel, which clearly showed Costa, the boy and Dougal enter the room together, the complaint said. The boy told police that he had engaged in sexual acts with Costa and Dougal, and was able to identify Costa in a photo lineup, but said he "did not want Brian in trouble." On May, 20, police say, they found 4,665 images and other videos of what investigators described as child sexual exploitations, while serving a search warrant on Costa's Portland home. Police say they also found two videos on the boy's computer in which Costa allegedly was engaged in sexual activity. Dougal was charged with using a minor to produce a visual depiction of sexually explicit conduct and possession of child pornography.
