Richard "Ricky" Michael Fay, 38, faces felony child porn charges and misdemeanor sexual abuse charges stemming from a second inappropriate relationship with a minor, according to a document filed Friday in Jackson County Circuit Court. Between Feb. 10 and June 2, the second minor victim sent Fay at least one explicit photograph of herself, and the victim and Fay had touched each others' genitals, the document filed by the Jackson County District Attorney's office says. Fay, a teacher at South Medford High School, was released from Jackson County Jail Monday after he posted $50,000, 10 percent of the $500,000 bail set Thursday by Circuit Judge David Hoppe. Fay now faces seven felony charges and three misdemeanors, including two counts of using a child in the display of sexually explicit conduct, two counts of second-degree encouraging child sexual abuse, two counts of possession of materials depicting sexually explicit conduct of a child, a felony count of luring a minor, a misdemeanor count of attempted second-degree possession of materials depicting sexually explicit conduct of a child and two misdemeanor counts of third-degree sexual abuse. The social studies teacher was arrested June 2 after Medford police detectives performed a forensic analysis on the smartphone of the minor female, a student of Fay's, in late May. Police said the forensic analysis turned up evidence of sexually explicit text messages exchanged between the first minor victim and Fay during the school year. Fay allegedly requested and received explicit photos of the first victim. Medford School District spokeswoman Natalie Hurd said there was no previous record of any complaints filed against Fay during his two-year tenure with the district. After the arrest, the district removed Fay from the classroom pending the outcome of the investigation. Morrow County School District Human Resources Director Erin Stocker confirmed that Fay taught social studies at Irrigon Junior-Senior High School in northeastern Oregon from August 2010 through June 2014. Coos Bay School District 9 Human Resources Director Candace McGowne said Fay taught social studies at Sunset Middle School and completed his contract in the 2007-08 school year. She said she couldn't confirm or deny complaints filed against a teacher. Fay has no documented actions against him from the Oregon Teacher Standards and Practices Commission, which makes sanctions, but not complaints, against educators public.
