Oregon Road Conditions & Cams Email Story to a Friend May 21, 2005 Teens won’t face prison in explicit-photo incident By SARAH LEMON Mail Tribune Two teens previously charged with taking sexually explicit photos of an unconscious girl during a party will be sentenced as adults but will not serve prison time. The district attorney Friday in Jackson County Circuit Court filed felony charges of second-degree encouraging child sex abuse in exchange for pleas from 17-year-old Adam Bauer and 16-year-old L.C. Graham. Prosecutors withdrew Measure 11 charges of using a child in a display of sexually explicit conduct, which carries a mandatory sentence of 5 years and 10 months. Bauer, of the 200 block of West Gregory Road, Central Point, pleaded guilty. Graham, who lives in the 1300 block of Spring Street in Medford, pleaded no contest. Bauer and Graham are not suspected of taking photos of the victim or developing the film but were "active participants" in the crime, said Matt Chancellor, deputy district attorney for Jackson County. Chancellor recommended a sentence of probation and 20 days in jail. They will be sentenced following a standard pre-sentence investigation conducted in sex crimes. The boys also agreed to testify against Bauer’s brother, 24-year-old Dominic Steven Bauer, who remains in the Jackson County Jail. He faces four counts of first-degree encouraging child sex abuse and two counts of using a child in a display of sexually explicit conduct. Advertisement Another defendant, 17-year-old Nicholas Daggitt, of the 2400 block of Medford is set to change his not-guilty pleas in a Thursday court hearing. The crime came to light in September when Adam Bauer showed the 16-year-old victim photos of her genitals and breasts that had been taken at a June party, investigators said. One photo showed a male’s hand touching the girl’s exposed breast. The girl obtained the photos and showed them to a high school counselor. School officials contacted police. The victim told detectives that she blacked out after drinking beer with the defendants, whom she considered friends. She recalled nothing more from the night and was confused when she awoke missing her pants the next morning at another friend’s home, investigators said. The girl said she had an aftertaste in her mouth that morning, which might indicate she was slipped a "date-rape drug," such as Rohypnol or GHB, said Ernie Whiteman, school resource officer at North Medford High School.
