COMMENTARY by Benny Johnson — "Witness Inside Charlie Kirk Trial Reveals The DAMNING Evidence that Will END The Case" (published 2026-07-10).

All right, ladies and gentlemen, we have Jack on the phone here. Uh Jack, thank you so much for joining us. I know that everything gets fried and scrambled when there's that much security at the courthouse. I want to dive right into it with this Lance Twigs 30inut testimony that the prosecution has. What's going on with that? Why is this such an outrage that this is now being redacted and censored? Well, Benny, thanks so much for having me on and thank you for your fight and for your words of support for Erica and the family as you've been doing all along. Your fight for the truth. Look, this is an outrage because Benny, people like you and me and those of us who are close to Charlie, we've just wanted the truth. Ever since we've been to the right, ever since we got past that first video, we wanted to know who was it that fired that shot? Why did he fire that shot? What happened? Why did Why did we lose our friend? And how did we get to this point? And this is finally now that they are sitting on key evidence of not just someone who was, you know, witnessed something far away, but the roommate of the accused shooter, the person who was in a relationship with him, the person who received the confession note, the letter, the text messages, who knew about the radicalization that was going on. And there's a 37 minute video and audio interview of this individual who by the way is the trans individual that when we talk about the trans issue being involved, this is the transgender person who has now come forward or or at the time came forward and then came forward again in April for these interviews and will, by the way, be called to speak at the trial. And for those of us who want truth, for those of us who want all of this on the record, the fact that they are blocking it, the fact that they are denying us access to this crucial information, it speaks not just to the integrity of this case, but it speaks to the very integrity of the judicial process itself. How can we function as a society if we don't understand why these crimes are being these heinous and evil and despicable acts are being committed in our society? >> Under what grounds would anybody be able to block this? This seems like the core pillar of the state's case against Tyler Robinson. How can you just erase that? >> Well, I I'm personally I'm I'm just livid. I'm I'm I couldn't be more angry about this. And I'm I'm by the way, I I commend the fact that the Kirk family's personal lawyer filed a motion early this morning and worked all night to get this up, stating exactly that, that the presence of the family in the courtroom is not meant to be hollow. It's not a hollow presence. They need a meaningful presence. And a meaningful presence is, let's let's keep in mind, Benny, this isn't just about showing the public the evidence. It's not just about showing, you know, guys like me and you the evidence. It's about the family, letting the family see the facts and see the evidence to try to find some kind of closure in the midst of chaos as to what happened to their beloved husband and son. And now they're turning around and saying, "Oh, well, you know, this amounts to a confession, and we don't want to air a confession in a pre-trial setting. It could prejudice the jury." or some of these acts that they discuss are of a personal nature. And since it's of a personal nature, talking about their relationship, for example, then how is that relevant to what he did on the UVU campus? Again, Benny, they are just throwing up roadblock after roadblock, pulling out anything they can find to try to block this. And the judge is going along with all of it. Look, they got this hot shot lawyer out of LA, Richard Novak. He's known for this kind of stuff. He's known as a a top criminal defense attorney. And this is what he does. He blocks evidence from getting into the court. And here in Utah, the prosecutors, they're good people, but this is a guy who's very, very slick and he knows exactly what he's doing. So can you walk me through since you have been inside the court the entire week the architecture the nodes of the new information that we have learned including but not limited to the transactions that happened digitally on credit cards that were owned by Tyler Robinson. I think that's quite remarkable how a Chick-fil-A receipt might be able to atomize every conspiracy theory about Tyler Robinson's presence that day. What have you learned, Jack? >> Well, that's exactly right, Benny. The the So, we have the video, and by the way, the video that's being played in the courtroom is like four times more uh 4K. I mean, it is like 4K, 10 times more um crystal clear and high quality than what you guys are seeing, you know, broadcast off of that monitor in the courtroom. We can see it perfectly from our vantage point. And it that's another thing that's causing me a lot of frustration that those videos are no longer being uh sent out in full quality. That's something that I've actually asked to to fight for and that we do need to get and and possibly will be making a human events filing later on. But when we're seeing that we get the videos, but then there's the corroboratory evidence that goes along with the videos. So you pointed out exactly the Chick-fil-A purchase that can be timed with financial transactions. You know what else, Ken? Did he stop for gas at all between his home in St. George, which is three hours away in Washington County to here in Utah? So, as he's driving through the Utah desert, if he stopped for gas, that will be tied with his car, that will be tied with a financial transaction. And then what we what we expect to get to at some point this week, we hope uh you know, depending on these uh delay tactics that we want to get cell phone information because there's something with cell phone that I don't think people realize. Not only does it give you track, cell phone information can give you elevation. And that means the cell phone data can see if someone was, oh, I don't know, going up and down stairwells or perhaps climbing on a roof at a particular moment on a particular roof on a particular or at a particular time. This is all going to be key evidence to corroborate all of the video that we have seen. So the the prosecution and it's it's frustrating for those of us uh like you and I who live at the speed of the internet. We want to just go go go. They are very methodical. They are relentless. But they are laying out their case and building the foundation of this infrastructure of a of a homicide case, a classic homicide case against Tyler Robinson. So that is something that, you know, I've been looking for where people are gravitating to in order to try and continue the theory that Tyler Robinson wasn't actually there that day or that it wasn't actually him or this is some type of greater overall conspiracy architecture. Uh, and I mean the I think the last straw that's being grasped here is that it's not Tyler Robinson in the videos. So, you're telling me that when the actual full quality of these videos are released, what we're seeing on the internet is not was actually true, the 4K versions, you will be able to identify Tyler Robinson. >> Look, that's right. I mean, I was sitting there with Don Jr. the day that they played the videos and and he and I were chatting about this through the show last night and and both of us had made that point that to us sitting there in the courtroom, it's it's just obviously him. It's not even a question. It's it's clearly him. You can see him clear as day. Okay, he has a hat and sunglasses on, but it's, you know, he never changes his shoes or whatever. So, it's it's literally the same guy that we can see who's also, keep in mind, sitting just feet away from us and his parents are sitting in the next row from us. So, I mean, it's it's very complex. It's a small room. It's quite small. And so, we're all there. SWAT teams are all around the room constantly. Uh there sheriffs that are constantly around the room. So, security is extremely tight. But for for such a big issue, for such a big case, such a high-profile case, it really is such a small space. And there's that sort of juxtaposition about how we're all kind of in the uh in the thick of it, in the eye of the storm, as it were. But these videos, this evidence that's coming out is key. And by the way, I I would be remiss if I didn't mention the fact that the DNA match, the 89 to 95% DNA match on the towel and the screwdriver that's already been admitted into evidence. We are told that we are also going to be getting uh ATF evidence. So the ATF did the report on the rifle that was found and that evidence is supposed to come by the end of the week that will also show a match to Tyler Robinson. So, for example, if as you say, uh, if our hypothetical is that Tyler Robinson was not there, then you have to prove that if he wasn't there, then how is there an individual that looks exactly like him, who's using his credit card, who's driving his car, who's placing his DNA on towels and screwdrivers and uh and rifles along with his roommate and lover's DNA, who has access to all of those things seemingly, and who has been identified, by the way, by his own mother and father. And at some point, this is where there's a reason it's called reasonable doubt. You can have doubt, but there's a reason that reasonable doubt just becomes unreasonable. And that I would say that that's unreasonable to think that one other person would have access to all of those things. And keep in mind, prior to anyone had ever heard the name of Tyler Robinson. >> Yes. Correct. He didn't even go to school there, right? So there there doesn't there is no earthly explanation for him to be stalking the campus four times that day. >> Uh >> there's there's all other possible explanations just fall to the wayside because they don't hold up to scrutiny when you have a level of evidence like this. And by the way there's and I've made this point in other places. There's far more evidence against Tyler Robinson than there ever was against Brian Cobberger. And folks may remember Brian Coberg was the individual who was convicted of hacking to death those poor uh four sarardi girls up in Idaho. There was far less evidence against Brian Coberger compared to this mountain that we have against Tyler Robinson. >> Uh really quickly here, Jack, do you have any indication since you are able to see things we can't see, meaning you're able to watch Tyler Robinson, his defense attorneys, you're able to see them. uh speaking to each other and so on and absorb kind of the energy of the courthouse. Do you have any indication that they they're going to plead that they're going to just say, "Well, let's spare you the death penalty and get you a couple life sentences and just call it call it good." Uh or do you think they're going to take this thing all the way full through trial uh and jury uh decision? >> Well, look, obviously that's a question that's on everyone's lips. And I will say at this point I have not seen anything that indicates that any deals are in the works or on the table. So I would say at this point no deals. Um I'm not going to preclude the fact that there could be a deal in the future. We never know. Um every every prosecutor and attorney defense attorney is making uh careful to say if this goes to trial. Uh meaning that it is a potential question. That's also because the judge has yet to rule on the probable cause. Although I think everyone knows that we do have probable cause here. They they met that bar the first day uh in terms of the evidence they presented. So it could there be a deal? It's possible, but at this point it doesn't seem likely. >> Interesting. Uh and so then the trial would be taking place then months from now. >> Correct. This this is still going to carry on. >> I've heard I've heard um I've heard it could be end of 2027. I've even heard potentially 2028. >> Goodness gracious. All right. Yeah. >> Yeah, man. You hate to see it, >> man. You hate to see >> in, as we used to say in the Navy, strap in and embrace the soccer. >> Yes. Okay. Uh, any final takeaways, Jack? I know you have to get going, but any final takeaways? >> I I am I am about to walk in. I just say to everybody, thank you for your support. Pray pray for Erica and pray for the family. I know you guys already are, but continue to do that because yesterday getting that ruling that that the the evidence would not come out and we're hoping that it's played first thing this morning. U it was reported that they had a very emotional moment. I I was sitting right there. Obviously, it did not go the way that we wanted to say the least. That's what made us so outraged and so upset because they just want the truth. They just want the truth to come out and for the world to see what happened to Charlie. That's all they want. That's all they're fighting for. That's why they're spent. They could be anywhere else right now. And and believe me, none of us want to be there. At least of all that, none of us want to be in this courtroom at all. Believe me, I hate every second of this. This is horrible. And to then sit there and be stonewalled and be told that we flew all this way, we came all this way, we we're spending all this time, the scrutiny, the media, the security that's required for them to travel and and then be told that you can't even see the evidence. It's it's it's it's maddening. It's absolutely maddening. But please continue to keep Erica and and Kathy and Robert uh Charlie's parents in your prayers because they're in here fighting
