Defense attorney Robert Abel said this week that Medford and Jackson County investigators continued to question David Jurich after he had asked to speak with an attorney. Jurich, 25, in a videotaped interview with police, admitted to attacking 68-year-old David Evan Rice inside the room he shared with Rice on Oct. 28, 2004. Jurich said Rice “flashed” the younger man and asked him to lie down in bed with him. “He’s a rapist,” Jurich told detectives Bill Ford and Colin Fagan. “I just went insane after that.” Jurich told investigators he believed he struck Rice with a metal bar but wasn’t sure where he got the weapon or where he disposed of it. Rice’s naked body was found the next day in room 8 of the Relax Inn. Police later captured Jurich in Reno, Nev. Jurich spoke to police for about an hour, denying he had ever stayed at a motel with Rice before requesting an attorney. Fagan testified this week that he and Ford continued to talk to Jurich for another six minutes about a warrant for his arrest and extradition to Medford. When Jurich said he wanted to continue talking, the detectives re-read his rights. Jackson County Circuit Judge Ray White has yet to rule on the motion to keep the confession from jurors. Jurich’s trial is scheduled to start Nov. 15. Jurich and Rice had met in jail before living on the streets and occasionally panhandling together, Jurich told detectives. The night of the killing was the first time Rice had made a sexual advance toward him, he said. Jurich has filed notice of his intent to rely on the defense of extreme emotional disturbance. If proved, his murder charge will be reduced to first-degree manslaughter, which carries a mandatory 10-year prison sentence. If convicted of murder, Jurich could be sentenced to life in prison with the possibility of parole after 25 years.
