over 2 years. the Senate has lived with
the events called Abscam. These 2
years have been sad ones for Senator
WILLIAMS and his family. for the
people of New Jersey, for the Senate.
and for the thousands of Americans
Senator WILLIAMS has helped through
his legislative accomplishments.
No Senators have labored more on
mittee which lS charged with responsi-
bility for the standards of the Senate.
Since its report last August on Senator
WILLIAMS, I have agonized over my
own course of action
I am grateful for the help and
friendship Senator WILLIAMS extended
to me as a new Senator It was long
my sense of hmi that his service to
New Jersey was a testimony to his
caring and to his propriety
Now I have seen and heard Senator
WILLIAMS on tape-attending seven
meetings in five locations over 11
months in pursuit of Arab money for a
company. I have seen and heard him
saying no problem" when asked if he
could help the company obtain Gov-
ernment contracts. Most important, I
have heard him accepting that compa-
ny's stock certificates, which were en-
dorsed in blank and which he said pro-
vided him with foundations for future-
independence. Nothing in this debate
c angethat fin
My personal conict is complicated
by what many say has been an abuse
of power by the FBIan abuse which
constitutes entrapment or even an as-
sault on the legislative branch by the
executive. It is my hope that the
Senate will conduct an investigation of
Abscam. "
_ such an investigation cannot
erase the ethical question before us
with regard to Senator WILLIAMS. :
I am not a lawyer. My reading of the-
extensive report of the Ethics Com-;
mittee and the responses of Senator;
WILLIAMS has not been done with a
lawyer's eye. My hearing of the pastdays debate has not been done with a
lawyer's ear. It is the business of the
judiciary to say whether .0r not Sena-
tor WILLIAMS is guilty or innocent by
Judicial standards. _
We are not judges. We are the
Senate. It is our constitutional respon-
sibility, as Senators, to assess our col-
league's actions by standards we hold
for ourselves.
Like each of you, I carry in my own
heart and in my own head an idea of
the standards a Senator of the United
States should follow and exemplify.
For whatever reasons or friendships,
under whatever motivation or provoca-
tion-whatever may have been the in-
ducement or the entrapmentSenator
Wrurms behavior did not meet the
minimum standards expected of a U.S.
Senator and the Senate must react.
What is the proper reaction? The
Ethics Committee unanimously recom-
mends expulsion.
A search for exact precedents yields
none. In history, the 15 Senators who
have been expelled were all expelled
on grounds of treason. Three other
Senators, whom committees of the
Senate had recommended for expul-
sion after charges of bribery, either re-
signed or lost at the polls before the
Senate could act on the recommenda-
tions. The Senate never has been
asked to vote on the expulsion of a sit-
ting Senator who has been convicted
of such a felonyuntil now. If this
should happen again, our determina-92 tion will be the precedent.92 The House of Representatives has92expelled Members who have been con-
victed of certain felonies.
There is also instructive history in
he Senate's action on Federal judges.
hen a Federal judge did not volun-
_/tarily resign after having been found
to have taken illegal fees, these "high
cri'mes_ and misdemeanors" were
grounds for impeachment, conviction,
and removal from office.
With that much example in mind
and with Senator WILLIAMS case
under consideration, one must ask the
following questions:

duced public condence in elected offi-
tals? t
Second. What is the point at which
embarrassing behavior becomes unac-
ceptable behavior with regard to the
Senate's institutional integrity? '
Third. Should one mistake nullify
years of service?
Fourth. Should years of service nul-
lify one mistake? " _
Fifth. Can any other Senator imag-
ine doing in a similar situation just
what this Senator has done? .
Sadly for the Senate and for Senator
Wruxams, my answers to these ques-
tions point only to expulsion.
Bribery inverts and mocks the demo-
cratic process turning it upon itself.
Among other things, Senator Wn.-_
L-IAMS has been found to have taken a
bribe. _
Some of my colleagues have said to
me that they believe censure would be
a more appropriate remedy. But the
issue here is not a minor one. It is at
the core of democratic govemment,
the faith people extend to political in-
stitutions.
To protect that faith, the Senate has
created an Ethics Committee and has
vested that committee with guardian
responsibility ior the standards of the
Senate. A Senator should reject a rec-
ommendation of the Ethics Committee
only if that recommendation seems
very substantially unsupported by the
evidence before the committee and
very clearly inconsistent with the
standards of the committee and the
Senate. Nothing in this case, I am sad
to say, suggests such exceptions to me.
I will vote for expulsion. -

charges and is awaiting trial next
month. He faces a possible prison
sentence of up to 115 years" and
$50,000 in fines if convicted on all
the charges. -
Three other Pine Bluff men also
are charged with conspiracy in con-
nection with the arson case.
As a legislative aide and former
chief administrative assistant to
McClellan in the mid-1960s, Probst
helped author major anti-crime leg-
islation then pending in the Senate.
He also was a campaign aide to,

I would like to bring to your attention a statement made by
Captain Z. L. Newcomb, USN, which suggests a problem in our
anti-espionage efforts. I personally doubt that the statement

I would like to add that I have thought of writing to you
several times over the past year. Once to commend you for the
Abscam operation, a program for which the FBI received severe
criticism and a program whose merits I admired. More recently
I was impressed to read of the Bureau's use of a bil1bo§¥H a§"w---
wanted poster. A minor thing perhaps but nonetheless creative, ;
and I hope, effective. Such initiatives speak well of thg @§i,3aKQ I
of your leadership.

Dear Mr. President:
In light of the recent disclosures concerning the
Justice Department's handling of the "Abscam" sting
operation, we beseech you to take appropriate action.
It now appears that evidence exists, supporting
the late Kenneth MacDonald's innocence on bribery
charges in this case. As former colleagues of Mr.
MacDonald, we feel that his tragic victimization in
this investigation exemplifies a blatant misuse of
federal authority. An overzealous Justice Department,
hungry for a tidy conviction, cost MacDonald his caree
pride, and untold family anguish.
Our appeal to the Executive Office is four-fold.
First, we urge that you take a stricter stance con-
cerning the misuse of federal authority at any level.
Improprieties such as this one cannot be permitted to
continue.
Secondly, we encourage the prompt and thorough
completion of the investigation into the Abscam
operations, examining the roles of Mr. MacDonald and
the Justice Department officials very carefully.
Next, appropriate steps should be taken to com-
pletely clear Kenneth MacDonald's name of any guilt
in this operation.
Lastly, we request that some personal contact be
made with Mr. MacDonald's family. They have suffered
a great deal, and would find comfort in knowing that
the President of the United States is personally
interested in setting the record straight.110425

Malcolm Wheeler, said Abscanfa
most basic problem was that it was
not tightly supervised and moni-

The committee deserves credit
for not going off as half-cocked as
some of Abscam's most vociferous
critics in the Senate did.

not be intimidated by the grilling it
had to_go through during the Sen-
ate's investigation of Abscam.
Membership in Congress in no
way confers an immunity to scruti-
ny by law-enforcernent officials.
Indeed, as holders oi the public
trust, Senate and House members
should be held to an even higher
degree of moral and ethical conduct
than ordinary citizens. _

Re: Kenneth MacDonald
Dear Mr. President:
On November 18, 1983 the Borough Commissioners of
addonfield wrote to you concerning the tragic manner in
hich the U. S. Government handled our past Mayor Eenneth MacDonald. Since then we have received the follow-
ing relative to this matter:
1. December 17, 1982 letter from J. Steven Rhodes,
Special Assistant to the President for Intergovern-
mental Affairs, acknowleding our correspondence.
Mr. Rhodes indicated he was forwarding our letter
to the Justice Department for their consideration
and direct reply.
2. Januar ll, 1983 letter from Oliver B. Revell,
Kssistant Director, Criminal Investigation FBI!,
U. S. Department of Justice. Mr. Revell stated
that "the Select Committee rejected the conten-
1 tion that the government had improper motives in
indicting MacDonald".
I We do hope that the above is not the extent of a response
{to be received from your office. The preponderence of infor-
mation relative to ABSCAH and particularly the late Mayor
Kenneth MacDonald, creates significant questions as to the
appropriateness of both the FBI investigation and activities,ahd
alsothe entire process of the Grand Jury operation. For your
information I am attaching a recent news article from the
Camden! Courier-Post concerning the activities of ABSCAM
Prosecutor, Thomas Puccio. We are also attaching copies ofthe letter received from Mr. Rhoades and Mr. Revell. _
Mr. President,the more we read about the activities of
our FBI and our Grand Jury, the more we are convinced that our
Enforcement 553 judicial system has perpetrated a significaHf_
injustice to the late Mayor Kenneth MacDonald and his family.
Ken MacDonald gave many years of his life in service to Haddon-
field, the State of New Jersey and our nation. Unfortunately,
a few overzealous federal officials have created a nearlv
unerasable taint on the reputation of the fine man.

We realize you are very busy, but we also realize that
Kenneth MacDonald was not too bus when the many calls for
~.his public service came. Therefore, we,are respectfully again!
requesting you review this unfortunate series of events, and
when you do, we fully expect you will:
1. Invoke stricter controls over misuse of federal
authority at any level; -
2. Complete the high level review of the FBI's and
Federal Prosecutor's activities in ABSCAM, and
particularly Mr. Kenneth MacDonald;
3. Determine that former Mayor Kenneth MacDonald
was guilty only of giving much of his life to
serve all of us and guilty of nothing of a
criminal nature;
4. Publicly and meaningfull¥ make contact with
Mr. Kenneth MacDona s amily, apologizing for
the governmental excesses that helped lead to
Mr. MacDonald's death.
Mr. President, as one of your predecessors stated -
"The Buck Stops Here" - and that is at your office. Former
Mayor Kenneth MacDonald gave very much to our country and
committed no criminal activities. His family deserves an
immediate apology, even if it requires our government to
admit that it engaged in ille al and inappropriate activities
in the ABSCAM investigation and prosecution. Your efforts
in Mr. MacDonald's situation will be greatly appreciated
and most appropriate!

Dear Mr. President:
In 1982, Kenneth MacDonald of Haddonfield died, knowing he
was a victim of Federal government excesses. These excesses,
under the umbrella of "ABSCAM", an investigation designed to
uncover corruption and influence - peddling in government, had
their heaviest toll on Kenneth MacDonald.
In addition to his service to our country in the Armed Forces,
Kenneth MacDonald gave many of his days and hours in public service -
serving as Mayor of and Borough Commissioner in Haddonfield and a
New Jersey Casino Control Commissioner. These were just three of
the many responsibilities he assumed in trying to make government
responsive, efficient and meaningful.
We know that Ken MacDonald is now with our Lord, as Ken did
know Christ. Unfortunately, his family and friends still carry
the burden of the false accusations and shame from ABSCAM. We be-
lieve that at the first anniversary of his death, it is about time
something was done.
The Office of the President possesses great powers that can
mobilize troops, money, support and sensitivities. We are asking
that you order the necessary steps for our Federal government to
absolve Ken MacDonald's name of all charges. Ken MacDonald spent
the final tragic days of his life attempting to clear his name.
You can complete that effort. _
As I said in my last letter to you dated January 31, 1983
"The Buck Stops Here" in your office. If it were in the power of
my office, Mayor of the Borough of Haddonfield, I would order pro
cedures to clear Ken's name and publicly apologize to his family
and thank them for Ken's many years of public services. I have
done what I can by writing to our country's highest elected official.
