The Ministry of Foreign Aalrs ct the Union of Soviet
Socialist Republics presents its compliments to the Em-
bassy of the United States of America and with reference
to the Emhassys note at July 80, 1960 has the honor to
state the following:
- As is known to the Embassy, criminal procwdings have
been instituted against American citizen Francis Gary
Powers under Article 2 of the Law on Criminal Responsi-
bility for State Crimes Espionage!. If. Powers will be
tried according to the laws ot the Soviet Union. The
Powers ease has been accepted tor consideration by "the
Military Oolleglum of the Supreme Oourt of the 11.8.5-B-.
open court session of which has been set tor August 17.
The competent Soviet organs consider it possible to solve
the question of a meeting of an oclal of the U.S. Em-
bassy with F. Powers at the end of F. Powers trial.
Considering the circumstances or the case, the Ministry
ot Foreign Aifalrs declines the protest or the U.8. Em-
bassy contained in the note of July 80 and expresses sur-
prise at the term to which the Embassy resorted tor ex-
pressing its requests to the Ministry ct Foreign Aifalrs
ct the U.S.S.R.
As tor the other questions presented in the U.B. Em-
bassy's note oi! July 80, an answer to them was given in
the U.S.B.R. Ministry of Foreign Aairs Note ct August

'Ihe Government of the United States has the
honor to refer to the Soviet Governments note of
J rme 30, 1960, which alleges that the Government
of the Federal Republic of Germany is attempting
to utilize the Western Sectors of Berlin for mili-
tary preparations.
The Government of the United States can con-
rm without hesitation that the recruiting of mem-
bers of the Bundeswehr is not taking place in
Berlin. Moreover, there is no conscription for the
Bundeswehr in Berlin and no organizations which
register individuals for military service. Further-
more, there are no organizations in Berlin which
have the character of reserve units of the Bun-
deswehr and no Federal law subordinating the
Berlin economy to the defense needs of the Fed-
eral Republic is applied in Berlin. As there
is no recruitment for the Bundeswehr in Berlin,
there is no question of using Allied communica-
tions to transport contingents of recruits for the
Bundeswehr from Berlin to the Federal Republic.
Had such situations been found to exist in conict
with the special status of Berlin and with their
own responsibilities for Berlin, the Allied authori-
ties would, of course, have taken immediate steps
to remedy them. . _
Such situations do, however, exist in the Soviet
Sector of Berlin and the Government of the United
States would like to believe that the Soviet Gov-
ernment now proposes to take measures to put an
and to them. Moreover, the Government oi the
United States hopes that bellicose demonstrations
by East German military and para-military forces,
as for instance on, May 1, 1960, in the Soviet Sec-

under the authority of the Berlin Senat. They
would have no force or eect if they were con-
trary to existing laws, including Allied Control
Council Law 43 which prohibits military produc-
tion in Berlin. ~ - ' .
~ A The Government of the United States notes that
s _a dierent situation now obtains in the Soviet
Sector of Berlin, where Allied Control Council
Law 43 is no longer respected. An ordinance on
the General Conditions for the Delivery to and
the Provisioning of the Armed Forces of the Ger-
man Democratic Republic was published in the
Soviet Sector on December 16, 19§9.
The Soviet note not only makes unfounded
charges regarding the violation of the special
status of Berlin in the Western Sectors but also
proceeds totally to disregard that status, in viola-
tion of the Soviet Unions pledged obligations, by
asserting that Berlin is on the territory of the
German Democratic Republic. As the Govern-
ment of the United States has frequently pointed
out, the pertinent quadripartite agreements relat-
ing to the Allied occupation of Germany clearly
conrm that the Greater Berlin area is not part of
any zone and that by "no thesis can Berlin be said
to be on the territory of the German Democratic
Republic . _ . . ~
Assertions of provocation where none exist
and assertions contrary to clear agreements al-
ready reached among the powers concerned only
complicate the task of nding solutions to the out-
standing problems which the United States, for
its part, believes require diligent eorts of both

The American U-2 spy plane brought down on May l, 1960, near
Sverdlovsk, 1,350 miles inside the Soviet Qnion, was not an accident.
Neither was it brought down by a super anti-aircraft missile.
According to a report sent from behind the Iron Curtain by the
Russian underground movement, the "Russian Revolutionary Forces" -- RRF -
the U-2 was captured by the Soviets as the result of a plan carefully
carried out by a Comunist intelligence unit called "Molnia" so that
Khrushchev could deliberately wreck the Paris Summit Conference and use
the spotlight of world publicity to blame_President Eisenhower for the
failure. Its capture was also to mark the commencement of a new Comunist-
sponsored vitriolic anti-American campaign that has since met with great
success in Japan.
The Russian underground report states: "For

landed at Pribaltica with one or two members of its crew still in a

Initially the Kremlin claimed that the [email protected] shot down from a

height of 60,000 feet by a new anti-aircraft missile. At first that
story was generally accepted as a true version of events. Later people
had their doubts.
It is now reported from authoritative sources in Washington, D. C.,
that the U-2 lost altitude and was forced down from a height of approxi-
mately 30,000 feet. The same sources allege that this was confirmed by
the NATO radar network which tracked the plane. As a result of this
knowledge there is a strong "rumor" in the American capital that the
pilot of the U-2, Captain Francis Powers, was drugged prior to take off.
To date neither the U. S. Central Intelligence Agency CIA! or the U. S.
Air Force has comented on this 'Eumor" and, accordingly, the Russian
underground report assus even greater importance.
Still quoting Moscow sources, the pilot of the U-2 did not use his
ejector seat when bailing out from 60,000 feet. Instead he chose to
make a miraculous parachute jup. His reason, according to Moscow? He
knew the ejector seat mechanism was faulty; that it had not been checked
for months and if he had used it he would have been killed., The Kremlin
the seat the carefully forgot to mention that if Captain Powers had used
top secret plane would have been automatically destroyed.

why the Soviet defenses allowed the plane to penetrate so deeply inside
Soviet territory and no pilot would have agreed to fly a high altitude,
long range mission in an aircraft that he knew, prior to take off, to

fide spy instead of sticking to his cover story that he was an employee
of the Lockheed Aviation Corporation whose task it was to fly near to
