"On Docena Road, the two boys on the
bicycle were approached by a red motorbike
which was decorated with Confederate
stickers and carrying two white youths.
One or the youths pulled out a pistol and
fired twice. Virgil Ware fell off the bike,
fatally wounded.
"Two white youths, Lee Farley and Larry
Joe Sims, both 16, have been charged with
murder and bound over to a Birmingham Grand
Jury that will convene Monday.
"Tom Olson read about the shooting in
the papers and wrote his friend a consoling
letter. Here is lee Will's reply:

"'Things are really going bed for me
down here. Virgil, my brother's iuneral will
possibly be Sunday.
"'The newspapers don't give a complete
rundown of what's going on around here. Our.
darling Governor has caused so much trouble,
until I am about ready to leave this place.
But I figure this is what he wants. A11 of the
Negroes to leave Ala. the nut!.
"'THE LITTLE girl Denise McNair was my
next door neighbor's niece. As you know she
was one of the girls who was killed in the
bombing of the 16th St. Bapt. Church.
"'I've been in school since the beginning
or the semester but is quite hard to study with
the tear that engulfs B'ham. We have n fire
drill almost every morning because of a bomb
threat.

"'All of the Negro businesses have
closed up and near dark there isn't a Negro
to be seen on the street. And could you
blame them? The State Troopers sent here
to protect us will ride along the street
with their rebel flagged cars saying run
nigger.
"'It's quite difficult to irite 1
cheerful letter under the circumstances but
in spite of all I guess I still have a lot
to be thankful for. Don't forget to come
to my funeral when ever you read about it.

Dear Senator Robertson:
Last night September 15! Washington tele-
vision station WTOP broadcast a recording of some
statements made in Baltimore by Governor Wallace or
Alabama. In one statement the Governor charged that
since 1947 there had been 47 bombings in Alabama of
Negro homes and churches but that the Federal Bureau
of Investigation,which had investigated evey case,
had railed to come with a single solution.
The Governor intimated that these bombings
had very likely been committed by persons with pro-
Negro sentiments who hoped through the "liberal"
press and networks to arouse hatred against white
persons in Alabama who are opposed to racial inte
gration. He said that no Negroes had been killed
and that personal injury and property damage had
been slight. But that the integraion forces,
through the publicity given to the bombings, had
succeeded in attracting much sympathy and money to
their cause.
Governor Wallace also intimated that the
F.B.I. in their investigations must have found
evidence of this duplicity on the part of the pro-
Negro forces. He said that such evidence if any
has not been brought to light because of embar-
rassment it might bring to the United States
Department of Justice and the Attorney General.
I real that the charges made by Governor
Wallace are serious ones which bring into question
the integrity our system or Justice on the Federal
level. I therefore ask that the charges be looked
into to determine their truth or falsity.

- I Birmingham in its efforts to run down sourcesE7 of dynamite has ascertained there are tee menufaeturers ofldynamite in Alabama; E. I. DuPont at Watson and Hercules at
Mcadory. These two companies have one wholesale outlet in
Birmingham apiece and these wholesale outlets have a total of
200 regular wholesale customers. They also sell retail. Due
to the large mining operations in Birmingham the use of
explosives is widespread and few accurate records are kept.
Birmingham is continuing this project.
Additional interviews have been conducted in the
neighborhood of the 16th Street Baptist Church without pertinent
information being developed.

This trial resulted in his conviction following which he was
ned $100 plus costs and sentenced to six months in jail at
hard labor. SAC Moore advised that the prosecution put on

by the Alabama Highway Patrol AHP! on 9-29-63, in connection

an explosive, to wit, dynamite, without a permit as required

more sticks of dynamite, at the 16th Street Baptist Church,

About 1:30 AM, September 25, 1963, persons in
the vicinity of 1601 Center Street, South, a well maintained
Negro neighborhood of medium priced homes, reported an explo-
sion to the Police Department. At 1:45 AM, a second explo-
sion of greater intensity, possibly several sticks of dynamite
occurred at the career adjacent to the captiened address.
This second explosion shattered a telephone pole, blew a
small crater in the curbing and showered the neighborhood
with high oxidized nuts, bolts and other metal fragments,
which caused extensive shrapnel damage to surrounding property
but no injuries. Laboratory reports dynamite residues on
fragments. First explosion believed to have occurred within
ten feet of the second and was believed to be lure to cause

On November 26, 1957, a source advised that the
United White Party UWP! was organized at a convention held
in Knoxville, Tennessee, on November 10, 1957. An article in
the November 26, 1957, issue of the "Greenville Piedmont",
a newspaper of Greenville, South Carolina, reported "the
recent formation of a new political party, to be known as
the United White Party". According to the article, the
party was formed at a recently held meeting in Knoxville,
Tennessee, at which many klansmen were represented. The
UWP was reported as being opposed to all "race mixing organi-
zations and individuals".
The July, 1958, issue of "The Thunderbolt", self-
described as the "official Racial Nationalist Organ of the
National States Rights Party" NSRP!, reported that rank and
file "States Righters" had merged with the UWP under "the
banner of the National States Rights Party", with national
offices at Post Office Box 261, Jeffersonville, Indiana.
In November, 1958, a source advised that the NSRP
is composed of past members of klan-type organizations and
notorious anti-Semites.
Issue Number 19, dated June, 1960, "The Thunder-
bolt", announced the address of the headquarters of the
NSRP had been changed from Jeffersonville, Indiana, to
Post Office Box 783, Birmingham, Alabama.
On June 17, 1960, a source advised that EDWARD R.
FIELDS, the Information Director of the NSRP, is the indivi-
dual who "runs the NSRP".
"The Thunderbolt" continues to publish articles
attacking Negroes and persons of the Jewish faith.

daily newspaper at Birmingham, Alabama, for September 8,
1963, on Page A-4, carried an article, "Two Arrests Made
in School Disorders". The article stated that two Birmingham
men had been arrested by Birmingham Police in connection
with demonstrations on September 4, 1963 at two city schools
where desegregation had been scheduled. The article iden-
tified one of the men as DAVID STANLEY, l8, of 1865
Bessemer Road. The article stated that STANLEY was chargedwith Assault with Intent to Murder for throwing rock at the///
Graymont Elementary School which rock struck an officer.

On September 10, 1963, the Red Star Final Edition 92
of THE BIRMINGHAM NEWS on Page 1, carried headline "Nine
Adults Arrested at West End." This article stated that
Birmingham Police on September 10, 1963 had arrested at least
nine adults; two after a brief battle outside of Nest End
High School. The article stated that about 1,000 students had
refused to enter the high school building after the Negro
girls had been enrolled. It was also stated that about 200
adults, some of them NSRP Members, reportedly passed out
literature urging a white boycott of any racially mixed schools
The article stated that the Birmingham Police Department began
making arrests when some of the above mentioned adults failed
to move or after having been ordered to do so, and that
STANLEY, age 18, was one of the two arrested.
On September 16, 1963, a Special Grand Jury Session
was convened in Birmingham, Alabama for the U. S, District
Court, Northern District of Alabama. The purpose of this
Federal Grand Jury was to act as an investigative body and
tully probe into any possible obstruction or interference by
any individuals or organizations with the orders of the U. S.
District Court, Northern District of Alabama, Birmingham,
requiring desegregation of three Birmingham schools, which
Court orders were then outstanding and in effect.
On September 23, 1963, the above mentioned Special
Federal Grand Jury returned indictments against eight
individuals in regard to the above mentioned matter. One
of the persons indicted was DAVID STANLEY.
