OUR
MONTGOMERY'S fame and popu-
larity as a tourist city grows and
grows. Everybody gets here soon-
er or later. All are welcome, the
more the merrier, and we otter dit-
ferent forms of entertainment for
every visitor.
_Since the days of the bus strike
and the treedorn riders. we have
had all sorts of guests.
We have had all the king's horses
and all the kings men.
We have people who use one by-
pass and people who use another.
We have received an Attorney
neral of the United States who
h s shown himself to be the worst
e emy the South has had since Thad
_ AStevens.
Now it appears that we are next
to have a Democratic President
that has done -all he could devise to
impose on ouifstate and who could
not in the last election receive a
majority of Democratic Alabama's
votes for president.
But they are all welcome. All are
politely received. Even it their trips
are purely political and hopeful of
keeping Alabama in the presidential
Democratic column next year, they
are still welcome. Perhaps on their
visits they are learning some thing
about Alabama that will be helpfu
both to them and to us in the fu
ture. -nnwspuper, city Cmd slate.!

lo Jury Trial
.'92s5't. U.S. Atty. Gen. Burke
Marshall said here last night
the Justice Department contends
that Mississippi Gov. Ross R.
Barnett does not l'ta'~'e a constitu-
tional right to a jury trial for
crirninal contempt of the Fifth
Circuit Court of Appeals.
Marshall. who heads the rte-
partrncnts civil rights division,
said this is the position the gov-
ernment will take in arguments
on the Barrett r-.'t~e before the
U.S. Supreme Court.
?92'larshall said the ;,'u92crt:n1cnt'5
position is that a jury trial in the
Burnett case is ttiscretiortcn-y with
the court, not mandatory. If it_3
should be held mandatory, he wont]
on, there would he a question of
whether it would he held uetore
the district trial court or before
the Court of .92pp¬l5.
Marshall conceded that it is
likely that Barnett trill he out of
office hetore the question of the
jury trial is settled and the actual
trial gets underway.
The issue of the jury trial went
to the U.S. Supreme Court when
the ourt of Appeals split evenly
nn the question. Four of the judges
held Barnett has a constitutional
right to a. jury trial u-hile the
other [our held that he is not.
The criminal contempt proceed-
ing against Barnett arose out of
his refusal to admit a Negro stu-
dent. James H. .92Tcredith, tn the
University of Mississippi as or-
dered by the appellate court.
