Ernest Harold Baker III was set to face a jury today. Jackson County Circuit Court rescheduled the trial for April 5, on a motion filed by Baker’s defense attorney. Baker has pleaded not guilty to a charge of aggravated murder in connection with the March 20 slaying of his son, Ernest Harold Baker IV. If convicted of the crime, Baker could be put to death. State prosecutor Beth Heckert said she has not decided if she will seek the death penalty. Aggravated murder — Oregon’s only death-penalty crime — applies to several scenarios, including the murder of children younger than 14. Jackson County sheriff’s deputies were called the afternoon of March 20 to a reported assault at the Baker home in the 2900 block of Wards Creek Road near Rogue River. The baby was taken to Rogue Valley Medical Center where he underwent surgery for a severe slash on his neck. He died later the same day, investigators said. Baker also had a wound on his neck when deputies arrested him at 6:46 p.m. He was treated at RVMC, kept in the hospital overnight for observation and later lodged in the Jackson County Jail. He remains in jail without bail.
