OUR VIEW Forest Service plan tramples First Amendment Comment MailTribune.com Writer Posted Sep. 25, 2014 @ 12:01 am Posted Sep. 25, 2014 @ 12:01 am » Social News U.S. Forest Service officials need a refresher course on the First Amendment if they think requiring journalists to get a permit and pay a fee to shoot photos or video in a wilderness area is constitutional. The agency is considering toughening requirements it says have been in place for four years on a temporary basis. Liz Close, the Forest Service's acting wilderness director, says the permit requirement is intended to preserve the untamed character of wilderness areas. It sounds more like the intent is to preserve the Forest Service's reputation by stifling any negative publicity. Reporters covering breaking news, such as a wildfire or a search and rescue operation, are exempt from the permit rule. But non-breaking news coverage, such as a story about forest management policy, would not be exempt. A permit costs up to $1,500, and failure to obtain a permit could result in fines of up to $1,000. Close says the  Wilderness Act of 1964 was intended to protect wilderness areas from being exploited for commercial gain, and this policy is intended to accomplish that. But news reporting is not exploiting wilderness for commercial gain in the same way as, for instance, shooting a car commercial in the Kalmiopsis would be. Besides, the First Amendment is crystal clear that no law may be enacted restricting the freedom of the press. That's where the Forest Service policy strays deep into the weeds. It gives the agency's supervisors discretion to decide whether a news organization's plans to photograph or film would advance the goals of the Wilderness Act. As Close told The Oregonian, "If you were engaged on reporting that was in support of wilderness characteristics, that would be permitted." The implication that a forest supervisor could deny a permit because a proposed video shoot would not be "in support of wilderness characteristics" is chilling, to say the least.  Mail Tribune photographers, who shoot video and still photographs on many subjects, say they have never applied for or been asked to obtain a permit to shoot in a wilderness area, and Close said she didn't know if any news outlets had applied for a permit in the past four years. The temporary rule is being finalized in November. The Forest Service is accepting public comments on the rule until Nov. 3, online at http://1.usa.gov/1v0c3gA. The final rule should specifically exempt news reporting from any permit requirement.
