John Patrick Bush, 30, of the 9100 block of Butte Falls Highway, will stand trial Jan. 25-28 before Jackson County Circuit Court Judge Ray White. Bush’s trial was scheduled to begin today, but prosecutors requested more time for the Oregon State Police Crime Lab to analyze forensic evidence. A grand jury indicted Bush last October for the April 2003 death of 29-year-old Robert Andrew Baker of Butte Falls. Police said Bush’s blood-alcohol level was .296 percent — nearly four times the legal limit of .08 percent — when he flipped his 1970 half-ton Ford pickup truck, in which Baker was a passenger. Bush faces charges of second-degree manslaughter, criminally negligent homicide and driving under the influence of intoxicants. The manslaughter charge carries a minimum prison term of six years and three months under Oregon’s mandatory sentencing law. Nearly nine years before Baker’s death, Bush was the driver in a crash on Obenchain Road that killed 21-year-old David Edward Buchanan of Central Point. Bush was indicted on charges of second-degree manslaughter and criminally negligent homicide in that case, but the charges were dismissed. He instead received a probation sentence after pleading guilty to DUII. Bush spent more than four months in jail on the latest case before posting $5,000 bond. He remains free pending trial.
