MARIJUANA LEGALIZATION Jackson County moves to tax pot Voters will decide whether to approve tax Jackson County Commissioners have authorized a marijuana tax and will ask county voters whether to approve it during a March 2015 election. By Vickie Aldous Mail Tribune MailTribune.com By Vickie Aldous Mail Tribune Posted Nov. 5, 2014 @ 1:23 pm By Vickie Aldous Mail Tribune Posted Nov. 5, 2014 @ 1:23 pm » Social News The Jackson County Board of Commissioners has authorized a tax on medical and recreational marijuana and will ask county voters to approve the tax during a special March 2015 election. State voters approved recreational marijuana on Tuesday, prompting the board's vote to authorize the tax on Wednesday. Because of provisions in the county charter, voters must approve the new tax. If adopted, the tax would go into effect retroactive to Dec. 1 of this year. State Measure 91, which legalizes recreational marijuana, goes into effect Dec. 4. It calls for legalization by July 1 and requires the state Liquor Control Commission to adopt rules by Jan. 1, 2016, for retail marijuana outlets. The marijuana tax rate would be set by the commissioners annually and could reach as high as 25 percent on sales of both recreational and medical marijuana. Medical marijuana is already legal in Oregon but remains illegal under federal law. Marijuana producers would be charged $35 per ounce on marijuana flowers, $10 per ounce on marijuana leaves and $5 per immature plant. People would not have to pay taxes if they were producing medical or recreational marijuana solely for their own consumption. The taxes would apply only to unincorporated parts of the county, not inside cities. Many Rogue Valley cities are adopting their own marijuana taxes. Under Measure 91, only the state can tax marijuana. But local jurisdictions hope that by adopting their own taxes prior to Measure 91 going into effect, those local taxes can be grandfathered in. "It's likely to be challenged somewhere, at some time in our state," County Administrator Danny Jordan said of the wave of local taxes on marijuana. If the county and other local jurisdictions are allowed to tax marijuana, Jordan said there's no way to estimate at this time how much revenue could be generated for the county. Jackson County Commissioner Doug Breidenthal said he personally opposes the legalization of marijuana, but approves of a county tax. "This will add a burden on the county financially," Breidenthal said, adding legalization will increase costs for county services like health and human services, while also putting added strain on local organizations that treat addiction and advocate for children. Breidenthal voted with Commissioner Don Skundrick to authorize the taxes. Commissioner John Rachor voted against the taxes. He said if citizens voted to legalize slavery or prostitution, he would not want to try and earn revenue off those practices. "I don't want to be in a position of saying, 'I want a chunk of it,'" Rachor said. Noah Soulé, who lives outside Talent and wants to open a dispensary between Medford and Phoenix, said the tax rates proposed by the county are far too high. He said a person who grows and sells marijuana would be double-taxed for both the production and sale of marijuana. "The people have voted," Soulé told commissioners. "Medical and recreational cannabis are the law of the land. Do not try to tax it out of our lives and out of our county." If there are county taxes, taxes on medical marijuana should be less than taxes on recreational marijuana, he said. Oregon officials estimate the state tax on marijuana will yield $17 million to $40 million annually. Measure 91 allocates 40 percent of state tax revenue to schools; 20 percent for mental health services and alcohol and drug treatment; 15 percent to state police; 20 percent for local law enforcement and 5 percent to the Oregon Health Authority.
