Men deny having sex with teen Two place third co-defendant at Medford mom's 1999 party By CHRIS BRISTOL Two of three men accused of having sex with a 13-year-old girl during a party at her mother's Medford apartment testified Monday that they never touched the girl. Although defendants Anthony Dewayne Smith, 32, and Johnny "JC" Carter, 39, denied the girl's testimony that they had sex with her, they admitted being at the party last summer and smoking what they thought was crack cocaine with the girl's mother, Lynda Darlene Hill. They also placed co-defendant Lamar Esquire McKenzie at the scene. McKenzie, 30, claims he was with relatives in California. "I saw Lamar and (the girl) go into the back bedroom," Smith said. The defense rested Monday, with closing arguments scheduled this morning. Hill and the men are on trial before a Jackson County jury on rape and sodomy charges. Smith testified he ended up at the party after stopping in Medford while on his way home to Sacramento from Roseburg, where he had been undergoing drug treatment at the Veterans Administration hospital. A 10-year Army veteran and married father of four, Smith admitted receiving oral sex from Hill. However, he denied that he had sex with Hill's daughter. "No, I did not," he said six times in a row, responding to scenarios posed by his defense attorney, Laurance Parker. Smith also testified that he had just awakened the morning after the party when Hill took a photo of him on the couch in his underwear. The photo, which shows the girl leaning on Smith wearing only a negligee-style robe, has been used by the prosecution as corroborating evidence. Carter testified he, too, received oral sex from Hill. Carter, also a married father of four, testified that he used the same robe the girl wore in the photo to clean himself afterwards. In an unusually combative cross-examination, prosecutor Judi Harper ridiculed Carter's story. Carter said he found the robe in a pile of dirty clothes, and forensic tests showed the robe had a semen stain on it. Carter also denied fondling the girl's 11-year-old sister, which contradicted the younger girl's testimony. McKenzie's estranged wife testified Monday that he called her several times from California during the time period when the party occurred. The date has not been fixed, although most evidence indicates it occurred around July 20. On Friday, members of McKenzie's family also testified that he was visiting them in California from about July 15 until early August, when he left to visit his sister in Texas. But that testimony was contradicted by McKenzie himself. In a taped police statement shortly after his arrest, he put himself at the party and described it as "a big orgy" _ although he denied having sex with the girl. McKenzie did not testify in court. Neither did Hill, who says she was too drunk to remember what happened that night. Earlier Monday, trial judge Patricia Crain dismissed a prostitution charge against Hill. The prosecution accused Hill of prostituting her daughter in exchange for drugs. Crain agreed with Hill's defense attorney, Jeni Feinberg, who argued there was no testimony to suggest such a scenario.
