Mike LaNier, the attorney representing the Kamerin Springs planned unit development, asked commissioners to approve shortening the distance required between the houses and property lines because of a design difficulty within the 12-acre, 50-lot project between Highway 99 and Talent Avenue. The developers are requesting the setback be altered from 8 to 5 feet for the first floor of a two-story residence, but keep continue to have the second floor conform to the standards. The development has already been adopted with the standard 8-foot setbacks. “We think it’s a reasonable interpretation of the ordinance.... We’re not trying to skirt the ordinance or change it,” LaNier told the commission. The planning commission was unsure if altering the approved plan was within their scope of authority. Instead, commissioners referred the issue to the city council. The applicants for the second development, the Alpine Meadow Estates, waived their 120-day legal limit for the commission to make a decision and will continue the public hearing on their 3-acre, 10-lot subdivision later this month and, possibly, into October. Issues with the size and layout of streets and alleys, as well as how future improvements to Alpine Way will be funded still need to be resolved. The possible appointment of a planning commissioner to fill the seat vacated by the resignation of Chuck Nagel in August was also postponed. Former Talent Mayor Frank Falsarella has applied for the position.
