i Director oi Public Saiety of Alabama, has been quoted in the papers3 as stating that the bombers  of captioned church! will eventually becaught due to: 
! large reward outstanding,
! that investigators for the State have
never ceased their efforts,
! that since the cache of the 137 sticks of
dynamite was recovered and three
individuals charged with the possession,
there have been no further bombings, and,
! State investigators expect to develop aconfession from one of the defendants. .    "i

It should be noted that the defendants are prime suspects who were arrested by the Alabama Highway Patrol for possession of the
&#39;-92 dynamite when the State Patrol found out that we were concentrating our

The negative information received as result of
investigation ct leads in this matter is not being set
iorth in this report. Some oi this pertains to automobile
license plate checks and miscellaneous interviews regarding
unknown suspects, the reporting of which would be oi no
beneiit in this matter. The material included in this
report does not reflect all investigation conducted prior
to 12/21/63. There is some overlapping oi investigative
periods reported herein which has occurred prior to sub-
mission oi referenced report.

I called SAC Faisst and stated that in reviewing his teletype
February 5, 1964, it appeared that the use of the word prosecutive summary
was improper inasmuch as we have no case which is prosecutable at this
time. It was pointed out that the Birmingham wire specically states that
we have no Federal violation; consequently, the use of the word prosecutive
summary would be improper. Faisst indicated that he would, therefore,
call this an investigative summary and his correspondence will reflect that. &#39;
It was indicated that it appeared that if U. S. Attorney Weaver was
such a good friend of the FBI office Faisst could talk with him about getting an
opinion to him on February &#39;7 rather than today. It was indicated that I did not
think we ought to be pushed to the point where this situation could not be given
proper consideration. He said he would call Weaver and, unless we heard from
him to the contrary, we could assume that Weaver will go along. He felt that
Weaver would be amenable to this suggestion. &#39;
I inquired as to whether we had turned anything over to the United
States Attorney or to the State in the nature of a report concerning this matter.
He stated that we had not. We had, of course, furnished information of interest
to the State periodically. I indicated that I was familiar with this and that such
information as was given to the State was on a liaison basis which was perfectly
satisfactory and that we should continue to furnish the State information which

I discussed the type of information which I thought should be furnished
to the Grand Jury. I indicated that I did not think it desirable at all to name

that I thought all that should be given was a brief statement that the FBI had
initiated an extensive special investigation at the very outs et of this case
and that we were continuing to exert all-out effort to bring this thing to a
logical conclusion; that we had cooperated with the local authorities throughout
the investigation and were continuing to cooperate; that we had conducted
extensive technical examinations of various types of material which may have
a bearing upon the ultimate solution of the case through the facilities of our
technical services at the Bureau, the Laboratory, Identification Division in
particular, It was indicated that I thought SAC Faisst should appear and state
to the members of the Grand Jury our position and assure them that we were
continuing our investigation looking to a solution of this matter and that we were
continuing to cooperate with the local authorities.
I advised Faisst he would be given advice as to the Bureau&#39;s position
and that he would have this advice by February 7.
He indicated he was preparing a summary of the information which
they developed which he thought might be given to the Grand Jury. This
would be given to U. _S. Attorney Weaver also and it would name names and
give the identities of principal suspectsmdthe nature of the investigation being
conducted. I advised him this was most undesirable, I thought, and that I did
not think we would approve furnishing any specific information at this time-
inasmuch as we had no Federal violation. It was indicated when we were ready
to present this case on the basis that there was a Federal violation in existence
we would then be in a position to give the United States Attorney a report. Until
that time there did not appear to be any obligation on the part of the Bureau
merely to give what could be considered an inadequate presentation to the
United States Attorney. I did not think this desirable.
The above information is for record purposes in connection with the
teletype which Mr. Faisst furnished to the Bureau on February 5. It is my
impression that Macon Weaver might be pushing for some comment in view of
the fact that Judge Allgood had called this Grand Jury just about the time of the
bombing and, of course, everyone in the area was commenting on their personal
interest in the case.

The Sixteenth Street Baptist Church  Negro!,1ocated
on the northwest corner of Sixteenth Street and Sixth
Avenue, North, Birmingham, Alabama, was bombed at about
10:22 A.H; on September 15, 1963. Four teen-age girls
I were killed and sixteen" other church members were injured

along the east wall oi the church and at the toot of
the stairs leading from the ground level to the main
floor. The explosion caused extensive damage to the church
and numerous windows were broken out in the neighborhood.;
It was concluded that a high order explosive was used and
the damage caused was approximately equivalent to that
of an explosion of about ten sticks of dynamite.

These Agents on the night of September 15, 1963,-
conducted an examination of damage to Sixteenth Street Baptist
Church at 1530 Sixth Avenue, North. These Agents can testify
to having found the following conditions present: -
 The characteristics of the damage, the distribution
of debris inside and outside the church, and the type of
debris, indicated e higheorder type explosive, such as dyne=
mite,had been placed on the ground in front of a double 7
window of the church and under an outside concrete stairway
that partially covered the double window. The stairway leads
from the ground level to the second floor level and is located
at the northeast corner of the church. The double windows
are in a basement room of the church known as the ladies
lounge, and are covered on the outside by heavy gauge pro-
tective wire screens, as are all the basement windows of this
church. T
The floor of the lounge was approximately four feet
below the window sill. The window sill was 8" above ground
level. The church foundation was 30" thick at this point and
consisted of a 16 stone facing over a 26" thick brick and
masonry wall. _
The explosion fragmented the outside concrete
stairway. Directly beneath the stairway and opposite the
window sill, in the ground, was a crater measuring 5} feet
wide, 2} feet deep, and it extended from the wall of the
church to the inner edge of the sidewalk, a distance
measuring 3 2/3 feet. The explosion fragmented the solid
limestone window sill and tore out the foundation of the
church immediately beneath the window sill. The window
glass, window frames and heavy wire gauge protective screens
were shattered and blown into the ladies lounge. Extensive

damage was caused in the interior of the ladies lounge. "
A large hole, approximately 7&#39; x 7&#39;, directly opposite the
window and 16 feet from it was blown out of a partition
forming one side of the lounge. This wall was constructed
of two thicknesses of bricks and covered with_wet plaster.
At the time of the examination, the floor of the lounge
was covered with 6" of debris consisting of brick, stone,
concrete, glass, mortar, plaster, wood lath, and wood from
a partition and from underneath and inside stairway.
The main supporting beams in the northeast corner
area of the church were weakened. Numerous windows through-
out the church were broken by the blast effect. -
The main effects of the blast inside the church
were confined to the ladies lounge.
Although there is no way of accurately determining
the amount of explosives used, the damage caused by the bomb
appears to be consistent with that which would be produced
by more than ten sticks of dynamite, or its equivalent. -
These two Agents can testify that a thorough search
was made of the explosion crater, damaged building, and the
surrounding area on September&#39;l6, 1963, being assisted by.
several additional agents. The search consisted of a piece-
by-piece examination of all debris. The following material
was found: - &#39;
! Pieces of heavy gauge wire from the screen
coverings over the windows in the ladies
lounge.
! Pieces of window frame from the windows in
the ladies lounge.
! Fragments of drapery material that covered the
windows in the ladies lounge.
! Part of the metal frame of the wire screen
covering the windows in the ladies lounge.

knowledge of any of them other than that afforded through
news coverage.
CEAEBLISS furnished what he stated was his best
recollection of his activities during the pertinent periods
of bombings oceurring since the Hay 11, 1963, bombing of the
residence of Rev. A. D. W. KING and the Gaston Hotel on thatday.  1
These agents again attempted to interview .
CHAHBLISS on October 29, 1963, at his place of employment,
Rebuilt auto Farts Compani, 1563 3rd Avenne Senth, Birmingham.
He showed_a hostile attitude and furnished little information
except criticism of the FBI.

Pursuant to an inquiry from United States Attorney  USA! Macon
Weaver, Birmingham, this recommends that SAC Raymond L. Faisst
voluntarily appear at a session of the Federal grand jury in February, 1964,
in Birmingham to give a brief statement concerning the Bureau&#39;s participation
in the investigation of the bombing of the Sixteenth Street Baptist Church.
This conclusion is based on the following facts.
BACKGROUND:
USA Weaver in Birmingham has advised that the Federal Grand Jury
Foreman Clarence Pinson has requested that some information concerning the
investigation into the church bombing be presented to the grand jury whichconvenes in Birmingham on 2/ 10/ 64. J "
_, U. S. District Judge Clarence W. Allgood has taken the same
position according to USA Weaver and the USA has indicated that he would issue
a subpoena for the Special Agent in Charge  SAC!.
USA Weaver was informed by SAC Faisst that if at all possible a
subpoena should not be issued and if it was agreeable with Bureau headquarters}and with the Department we would prefer to appear on a voluntary basis without
any element of compulsion being present. USA Weaver has advised he would

jeopardize our investigation.

SAC Faisst has recommended that either he or
to whom this case is assigned and who has just
Tafvoluminous material for the preparation of an investigative summary on the
case, be authorized to appear before this grand jury and furnish a brief summary
of the investigation conducted. According-to SAC Faisst, such summary would
include an identity of principal suspects and in some fashion what evidence is
available to justify their consideration as suspects. The objective nature of
our investigation would be pointed out noting specifically that all possible
suspects irrespective of their race would be given appropriate consideration
and investigative attention.
RECOMMENDATION:

SAC Faisst should appear and assure the grand jury in line with above.
The above request of the USA was discussed with Mr. John L.
Murphy of the CRD of the Department on 2/ 5/ 64.
It was pointed out to Murphy that as he knew following the bombing,
we immediately entered the investigation, sent a special squad of Agents into
the area and conducted thousands of interviews both in Alabama and neighboring
states in an attempt to bring about a solution. It was pointed out to Murphy
that we had voluminous memoranda and reports on the bombing but that in view
of the fact we had no prosecutable evidence to prove a Federal crime, we were
not disseminating the information. Murphy agreed and indicated that he was
satisfied that the Bureau was conducting an extensive investigation and until
such time as there was something concrete to go on or someone to prosecute
the Department did not require reports. He indicated it would be proper to
appear before the grand jury and indicate we are continuing to investigate this
matter in line with the above recommendations.

an extensive investigation of this case and that we are continuing to exert ali-
out effort to bring this matter to a logical conclusion; that we have cooperated
