July 12th, 1929, referring to my communication of May 27th
last, relating to charges made against officials of the De-
partment who were instrumental in the prosecution of Subject
Haleo
Special Agent Frank S. Smith of this office has
conferred with United States Attorney Roy St. Lewis, Okla-
homa City, relative to this matter, and he has stated that
United States Attorney Goldesberry, Assistant Attorney General
Leahy and himself have replied to the charges made against them
to the Attorney General and that he does not desire any further
investigation at this time.

I enclose herewith copy of the issue of the Tulsa Daily
World", under date of Thursday, September 19, 1929, and call your atten-
tion to an editorial under the heading "Government Espionage", on page
8 thereof.
You will recall this is the matter about which I talked with
you when you were in Tulsa recently and in the office. The particular
thing of interest to this District is the W. K. Hale trial at Pawhuska,
mentioned therein.
This article charges that the government prosecutors, throughthe government agjgté, constantly watched the jury or Juggrz for weeks;
while the facts a that this is not true. The governme officers or the
government prosecution had no interest in watching the Jury at all in the
trial of this case, and did not do so; and none of the other matters men-
tioned in the article with reference to the Hale trial are true so far as
I know.
The matters menti ed therein with reference to the deal betweenfederal prosecutors and Dickzegg a convict witness, so I am advised! are
not the facts. Ly information is that Dick Gregg was released to the State
of Oklahoma by the Kansas Penitentiary authorities for the State of Okla-
homa's use in the trial of its state cases at Pawhuska, and was in charge
and custody of state officers when he made his escape, and the government
had nothing to do with it.
I think the gentleman who wrote this editorial ought to be in-
terviewed, and it should be ascertained where he got his information with
reference to these things, and probably he and his informers, if any,
should be called before a federal grand jury.to disclose these alleged vio-
lations, if they have any knowledge thereof, which I am satisfied they have
not.
