FCC ELIMINATES THE DEADLINE FOR NONCOMMERICAL EDUCATIONAL CLASS D FM STATIONS
TO FILE CONSTRUCTION PERMIT APPLICATIONS TO INCREASE THEIR POWER IN THE
RESERVED BAND
On June 7, 1978, in Docket 20735, the Commission established a deadline of
January 1, 1980 for the filing of construction permit applications by
noncommercial educational ten-watt Class D FM stations to increase their power
to a 100-watt minimum in the reserved band. Citing several reasons, including
the large number of such applications already filed and the alleged failure of
notice to some licensees, the Commission decided to eliminate this deadline
and accept this type of application whenever filed. However, the FCC
indicated that, in order to afford equity to the some two hundered and fifty
licensees who in good faith filed their applications prior to the January T;
1980 deadline, Class D power increase applications filed subsequent to the
deadline which are mutualiy exclusive with this type of application filed
prior to the deadline, will not be accepted for filing.
Sent to all Class D FM 10-watt noncommerciai educational licensees.
Action by the Commission January 29, 1981. Commissioners Lee, Quello,
Washburn, Fogarty and Jones, with Chairman Ferris and Commissioner Brown
not participating.
